General conditions of Sale
- These general conditions of sale ("General conditions") are governed by the Consumer Code (Legislative Decree No. 206/2005 and subsequent amendments) and by the rules on electronic commerce (Legislative Decree No. 70/2003 and subsequent amendments) and apply exclusively to distance selling through website of the Products shown on the website www.qgbags.it
- Prices The Price shown on the Website at the time the Order is sent is applied to the Products and Services, without any consideration of previous offers or any subsequent Price changes.
- Order Purchase Orders must be placed online through the order procedure (hereinafter"Order Procedure") present on the Site. The Purchase Contract will be considered concluded between the Company and the Customer upon receipt by the Customer of the order confirmation e-mail (hereinafter"Order Confirmation") to the e-mail address communicated by the Customer. This Confirmation will summarize the selected Products and Services, the relative Prices (including Delivery costs and additional costs relating to the additional Services requested by the Customer), the delivery address, the order number (hereinafter"Order number"), the General Conditions of Sale provided therein and any special conditions applicable to the single Order and determined following specific requests from the Customer. . The Order Number, generated by the system and communicated by THE COMPANY, must be used by the Customer in any communication with THE COMPANY. It is possible that there may be occasional non-availability of the Products offered, in which case, if the Products chosen by the Customer are not, in whole or in part, available, THE COMPANY will notify the Customer. The estimated times for the shipment and delivery of the products are purely indicative and not mandatory, therefore, claims relating to products delivered promptly or within 30 days of the Order Confirmation will not be accepted under any circumstances.
- Terms of payment Payment for the Order must be made when the Order is forwarded to THE COMPANY. Payment must be made online by Credit Card and/or PayPal, following the instructions on the Site; For the issuance of the invoice and\or receipt or equivalent fiscal document, the information provided by the Customer will be used as proof. THE COMPANY therefore reminds the Customer to always check, with the utmost attention, the accuracy of the information provided.
- Exports/exemptions and VAT concessions The Products are subject to the laws and regulations in force regarding customs and export control and therefore must be purchased, exported and used in compliance with these regulatory provisions. - Delivery Services THE COMPANY will deliver (hereinafter“Delivery Service” or simply the “Delivery”) directly or by specialized carriers specially appointed by THE COMPANY (hereinafter“Vectors”). At the time of Delivery, the presence of the Customer or a trusted person is required to check that the packaging is intact and clean and that the Products received correspond to what is reported on the Order. In the event of visible defects, such as the incorrect quantity and/or incorrect Product and the non-integrity of the packaging, the Customer or a trusted Representative will be required, under penalty of forfeiture of possible disputes or guarantees, to report the aforementioned anomalies on the transport document and immediately contact THE COMPANY at the addresses and telephone numbers indicated on the Site. In the event that the Delivery is requested in areas where traffic is subject to limitations and/or prohibitions, such as, by way of example, traffic restricted areas, areas with limited entry to vehicles, pedestrian areas or if the distance between the unloading point and the destination property of the purchased Products is more than 100 (one hundred) meters as well as in the event that the destination property of the purchased Products does not have a lift, freight elevator, or in any case a staircase and/or doors with dimensions and capacity suitable for the passage and lifting of the Products The Customer will be charged additional additional costs necessary for the aforementioned additional services.
- Delivery costs Delivery costs (below"Delivery costs") are charged to the Customer and adequately highlighted and detailed in the Purchase Order and in the subsequent Order Confirmation.
- Right of withdrawal If the Client is a"Consumer", as defined in article 3 of the Consumer Code, they are entitled to the rights referred to in articles 52 et seq. of the Consumer Code, as amended by Legislative Decree of 21/02/2014 n.21, and therefore the right to withdraw from the Purchase Contract (hereinafter"Right of withdrawal") for any reason, without explanation and without any penalty, in the manner specified below. The Withdrawal may concern all (Total Withdrawal) or only part (Partial Withdrawal) of the Products purchased by the Consumer. The Withdrawal period expires after14(fourteen) days from the day on which the Consumer or a third party, other than the Carrier and designated by the Consumer, acquires physical possession of the Products/or (hereinafter“Withdrawal Period”). The right of withdrawal is exercised by sending - before the expiry of the Withdrawal Period as indicated above - a notice of withdrawal (hereinafter "Notice of Withdrawal) by email to the following address: info@qgbags.it The notice of withdrawal must specify the intention to withdraw from the Purchase. The Return of the Product/s must take place within 14 (fourteen) days from the date on which the Consumer communicated his decision to withdraw pursuant to the express provisions of which to the Consumer Code mentioned above.
- Conditions for exercising the right of withdrawal The right of withdrawal applies to the product purchased in its entirety, integrity and in its original and/or sealed packaging; it is not possible to exercise withdrawal only on part of the purchased product. In particular, the purchased good must be intact and returned in the original packaging, complete in all its parts and sealed as originally. To limit damage to the original packaging, we recommend placing it in a second box, indicating the wording "RIGHT OF WITHDRAWAL", in any case avoiding applying labels or adhesive tape directly to the original packaging of the product. It is also understood that:
- Shipping costs are charged to the customer.
- – The sums paid for the purchase of the returned product will be refunded once the return has been received. In the case of items purchased with free shipping, the costs incurred by us for shipping will still be retained following the return.
- The right of withdrawal lapses, due to lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where the Company ascertains the lack of the external packaging and/or the original internal packaging where existing and/or the absence of integral elements of the product and/or damage to the product for reasons other than its transport.
- Exclusion of the Right of Withdrawal In the event that the supply concerns goods made to measure or clearly personalized must be considered excluded pursuant to article 59 Legislative Decree 206/2005 the right of withdrawal in favor of the consumer
- Legal and Conventional Guarantees for the Consumer Customer: The Consumer Customer (hereinafter,"Consumer"), as defined in the art. 3 of the Consumer Code (hereinafter,“Consumer Code”, Legislative Decree 6 September 2005, n. 206), has the right to make use of the legal guarantee provided for by the Consumer Code itself in articles from 128 to 132. This Guarantee provides, among other things, that the Consumer, under penalty of forfeiture, notifies THE COMPANY of any defect in conformity found by the Consumer in the product purchased within 2 (two) months of discovery (art. 132, Consumer Code). Following this complaint, the Consumer will have the right to request the repair or replacement of the Product, without prejudice to the other rights established by law in favor of the Consumer. By virtue of the above legal guarantee, THE COMPANY is responsible for any lack of conformity that occurs within 2 (two) years from the Delivery of the Product. Beyond this term, THE COMPANY will not be responsible for any lack of conformity found by the Consumer. In the event of replacement or repair of the Product, the terms of the guarantee relating to the Product given in replacement or resulting from the repair are the same as for the original product. Therefore, the total two-year duration of the legal guarantee will start from the delivery of the original product. In order to take advantage of the guarantee the purchase document must be presented. In any case, for the regulation of the legal guarantee, reference is made to the provisions of the Consumer Code referred to in articles 128 and following.
- Legal guarantee for the non-consumer customer (professional):The Professional Client, as defined in art. 3 of the Consumer Code, has the right to make use of the legal guarantee provided for in the Civil Code. This Guarantee provides, among other things, that the non-Consumer Customer, under penalty of forfeiture, notifies THE COMPANY of any lack of conformity found in the product purchased within 8 (eight) days of delivery. The above legal guarantee is valid for a maximum period of 12 (twelve) months from the delivery of the product. Beyond this term, therefore, THE COMPANY will not be responsible for any lack of conformity found by the non-consumer customer. - Conventional Warranties THE COMPANYIn addition to the guarantees indicated above THE COMPANY could offer additional guarantees on certain types of Products as will be indicated from time to time in relation to the same and as can be verified on the Website qgbags.it
- Processing of personal data The Customer's data is processed by THE COMPANY in compliance with the provisions of the legislation on the protection of personal data, as specified in the information provided in the appropriate section "Privacy Policy".
- Communications Any communication, without prejudice to the provisions of the previous art. 8 "Right of Withdrawal", may be addressed to THE COMPANY using the contact channels listed in the section“Contact Us”of the Site qgbags.it
